MIKE SMITH'S VOTING RECORD

Thanks to his repeated claims, Mike Smith is viewed as a “moderate” politician by some Democrats and Independents in the district. He is well-liked by many thanks to his self-promotion and branding. But his voting record shows he is not moderate at all. Listed here are his voting records as a member of the Delaware State Hose of Representatives, where he claims to be representing the people of House District 22.

REPRODUCTIVE RIGHTS

  • Voted against HB 31 (2021):  Ensured that women who took abortion pills at home would not be able to be prosecuted under Delaware law.  Similar laws are being used in Texas, Alabama, and Idaho to threaten women who end their pregnancies.
  • Abstained on HB 65 (2023) – despite sponsoring:  Allowed state employees to use bereavement leave after a miscarriage.  Losing a pregnancy can often be a painful experience and this legislation allows space and time to grieve and recover.
  • Abstained on SB 158 (2023): Provided address confidentiality for reproductive health care providers in Delaware.  Many reproductive health providers shared that they were unable to buy homes or were unsafe when they did.  This legislation ensured they were protected.
  • Voted against SB 301 (2024): Would require colleges and universities to ensure students have access to emergency contraception and abortion services.

VOTING RIGHTS

  • Voted for HB 73 (2020): the first step of a Delaware Constitutional Amendment which would allow Delaware voters to vote by mail. He then voted against the second step, HB 75 (2021), once voting by mail become controversial with some Republican voters.
  • Abstained on HB 25 (2021): Allowed for same day voter registration in Delaware. Same day voter registration has been demonstrated to increase turnout.
  • Voted for HB 121 (2023): Would allow corporations and LLCs based in Seaford to have a vote in municipal elections.
  • Walked out on vote for SB 160 (2023): On June 30th, 2023, Mike joined other Republicans in walking out this “Bond Bill” which funds the Food Bank of Delaware, the Clean Water Fund, the National Guard, and Delaware roads. These Republican State Representatives refused to return until the House of Representative agreed to pass HB 121.
  • Abstained on SB 3 (2024): Another attempt to pass a bill that would have been the first step of a Delaware Constitutional Amendment that would have allowed Delaware voters to vote by mail.
